PM's office denies claims Tony Abbott British citizen
A SUNSHINE Coast blogger's claim that Tony Abbott was not eligible to run for office because he failed to renounce his British citizenship has been dismissed by the PM's office.
Tony Magrathea reportedly submitted freedom of information requests to the Prime Minister's office and the British Home Office seeking a copy of the RN form that British subjects use to renounce their citizenship.
Both requests were refused, according to documents on his website.
Mr Magrathea, one of the Sunshine Coast Daily's most prolific bloggers, reported in June on his blog that he had sent a complaint to Australian Federal Police.
He has also sent questions via Facebook to the British High Commisson.
In April he posted: "Anthony John Abbott is the PM of Australia. He was born in London and took up Australian citizenship on 25/6/1981. Has he lodged a form to renounce his British citizenship with you?
"I know the contents of the actual form can not be released but a yes or no answer would not be in breach of the privacy laws. And if yes what date - so that the historical record of such an important man can be updated."
"Tony, as mentioned previously we are unable to comment on individual cases of renunciation of British citizenship,'' the response read.
Under the Australian constitution, people who hold dual citizenship are not permitted to stand for election to Federal Parliament.
Section 44 of the Constitution says they must not hold the citizenship of any foreign power.
Ninemsn reported it had contacted the Prime Minister's Office and the Department of Prime Minister and Cabinet seeking confirmation that Mr Abbott has renounced his British Citizenship.
After a three-hour wait, the office replied with this single-sentence statement:
"The Prime Minister is an Australian citizen and does not hold citizenship of any other country."
Mr Abbott was born in London in 1957, to a British father and Australian mother and emigrated to Australia in 1960.
He is a naturalised Australian citizen, and travelled to study at Oxford University on a Rhodes Scholarship that was only available to Australian citizens.
More than 4600 have signed a Change.org petition seeking the confirmation of Abbott's renunciation of British citizenship.
In 1996, Jackie Kelly was forced to face a by-election when she was found to have been elected while holding both Australian and New Zealand citizenship.
In the US, some citizens demanded Barack Obama disclose his birth certificate to reveal that he was born in the USA - a constitutional requirement for presidential candidates.
WHAT TONY MAGRATHEA SAYS ABOUT THE PM
Tony Abbott is the Prime Minister of Australia. He was born in London to a British father and an Australian mother, this automatically gave him British citizenship.
Shortly after being told he had won a Rhodes Scholarship Mr Abbott applied for and got Australian citizenship by descent from his Australian mother in 1981.
This did not nullify his British citizenship, he became a dual national.
Rhodes Trust changed their rules after Mr Abbott got his scholarship as a Briton.
He matriculated to Oxford University as a British citizen.
FOI requests to the Home Office in the UK and to the Department of Prime Minister and Cabinet in Canberra have failed to provide proof of the form RN needed to renounce his British citizenship.
The National Archives of Australia keep citizenship applications for everyone who applies to be a citizen.
These are generally public documents available to all. |for some reason the NAA made Mr Abbott's application file a secret document in February 2014.
Australia's constitution, section 44, precludes dual nationals from becoming members of parliament, but the Australian Electoral Commission can not check on the nationality of candidates.
They must rely on people telling the truth when they sign the declaration that they are eligible to stand for election to parliament.
This campaign is to raise money to lodge advertisements in national newspapers and to get legal advice on the processes we can follow calling on Mr Abbott to show he has renounced his British citizenship.
If he can not produce the relevant form RN this means he has entered parliament 8 times as a dual national. Once may be construed as a mistake, 8 times is a matter the police should investigate.
