No by-election in Ferny Grove: ECQ

THERE will be no by-election for the seat of Ferny Grove, the Electoral Commission of Queensland has announced. 

After receiving additional expert legal advice, the ECQ has decided against lodging a petition with the Court of Disputed Returns.

The electorate's votes were questioned after the Palmer United Party candidate Mark Tavener was found to be an undischarged bankrupt and therefore unable to run for the seat.

Based on preliminary legal advice received last week, the Commission intended to refer the Ferny Grove election to the Court of Disputed Returns.

However having regard to the final count in Ferny Grove, the winning margin, the number of votes for the PUP candidate, and the distribution of preferences, the Commission will not be making an application to the Court of Disputed Returns.

The ALP candidate, Mr Mark Furner, was declared the successful candidate by the Commission on Thursday.
