Man guilty over child porn

A MAN who downloaded child pornography off the internet pleaded guilty to a range of charges in the Bundaberg District Court yesterday.

The man, who cannot be named to protect the identity of his victim, also pleaded guilty to an act of indecency towards a child under 16.

Judge Michael Burnett was told police carried out a search of the man's house in December last year.

The man also pleaded guilty to possessing a dangerous drug, having objects to use in connection with a dangerous drug, failing to dispose properly of a hypodermic syringe, possessing a prohibited explosive, two charges of breaching bail conditions and obstructing police.

The court was told the man, his partner, and her 13-year-old daughter were on a family holiday when the man kissed the girl with his mouth open.

After the girl made a complaint to police the man was released on bail with one of his conditions being that he not contact her.

But when police raided his home they found SMS messages to the girl on his mobile phone.

The man denied downloading pornography but a forensic examination of his phone found six child pornography images that had been deleted.

The court was told while the man denied downloading child pornography he told police that there might be an image on his phone of a "young chick" who might be about 14.

But he told police while the images downloaded depicted the girls as young, he doubted they were.

He said they were dressed to look like that.

Judge Burnett said while the pornography had been deleted the man tried to downplay his criminality.

He said the crime of child pornography could only be perpetrated by the abuse of children and therefore was not victimless.

"There is a significant element of exploitation in producing these images," he said.

Judge Burnett said the man had been in custody for 130 days.

He sentenced the man to six months on the child pornography charge, but released him immediately on two years probation, and a month for contacting the girl.
