'I've got more criminal history than that', offender moans

A RECIDIVIST offender has complained to a Toowoomba court that he had wracked up more criminal history than what had been presented before the court.

Jordan Arthur James Weatherall at the age of just 25 had an eight-page criminal history, Magistrate Robbie Davies noted.

That prompted Weatherall to complain from the Toowoomba Magistrates Court dock that he had more criminal history than that.

His outburst prompted his solicitor Joe Millican to interject with the subtle submission: "Perhaps Mr Weatherall should be quiet and listen, Your Honour."

The 25-year-old had spent the night in the watch house after being picked up by police on a warrant for failing to appear in court on charges of possessing a dangerous drug and wilful damage.

He pleaded guilty to the charge of failing to appear in court and asked that the other charges be adjourned.

Mr Davies noted Weatherall had a history of failing to appear in court which showed a "bad attitude".

"You have to make sure you turn up to court," Mr Davies told him.

Mr Davies sentenced Weatherall to one month in jail but ordered the term be wholly suspended immediately for 12 months and warned Weatherall that the court would not tolerate any more no shows from him.

"What I'm saying to you is the court is fed up with you and your failure to appears," Mr Davies said.

Adjourning the other charges for mention in the same court on August 13, Mr Davies warned Weatherall that he needed to show up at court when required but granted him bail on those matters.

"What's going to happen if you don't show up?" Mr Davies asked the defendant.

"I'll get locked up again," Weatherall replied.

"You will. You've got no excuses," Mr Davies advised the 25-year-old.
