Mum sues kids for $200k in family feud

A mum has successfully sued her only son and daughter-in-law for more than $200,000 over a home she thought they would live in together.

Judge Gary Long on Thursday handed down his decision that money Pauline Ann Buchan had given to her son Gary Paul Young and his wife, Kym Louise Young, should be paid back to her.

During a trial last year, Ms Buchan told Maroochydore District Court she had given them the money believing it would be used to buy a property they could all live on.

According to RP Data, the couple bought a Kentish Rd, Kiels Mountain property for $510,000 in early 2016 which featured a house, shed and swimming pool.

While Ms Buchan was living in the UK, she and Mrs Young had exchanged information on available properties for more than a year before the Kiels Mountain property was bought.

Ms Buchan last year told the court that when the couple took her to see the home, she was surprised they suggested she could build a second home on the property.

The court heard messages revealed Mrs Young didn't want her mother-in-law living with them full time yet and thought she should live in a mobile home on the property for four to five years before they'd consider building.

Ms Buchan was in the UK on Thursday when Judge Long ruled in her favour.

She was "relieved" to hear he had ordered the Youngs to pay her $209,475.84 and a second sum of $7,757.73.

Judge Long ordered the parties to make written submissions as to costs within a fortnight.

The court did not hear Judge Long's reasons on Thursday but he said they would soon be published.
