Council orders in bulldozers on private motocross track

CLARENCE Valley Council has ordered a Glenreagh man to bulldoze a private motocross track on his property.

At Tuesday's meeting, councillors voted in favour of a motion from councillor Karen Toms to order property owner Bayden Blanchette to restore the track he built on his property three years ago to its original state.

Mr Blanchette, who owns a 40ha property on Tallawudjah Creek Rd, began his battle with the council at the end of 2016 when he put in a development application for the track.

At the time it was a contentious move as developments on rural properties generally fall outside requirements for DAs.

His neighbours used the opportunity to object to the noise level and dust coming from the property.

At Tuesday's meeting, CrToms said her motion to destroy the track was in response to the applicant's inability to meet the condition of accurate record keeping.

"I understand from the officer's report the condition was not met, despite the time frame given to the applicant," she said.

Councillor Andrew Baker questioned why the council had not taken action against Mr Blanchette for breaching the condition.

The director of environment, planning and community, Des Schroder, said because of the location of the track, council staff were not able to monitor its use.

Mr Schroder said that once the DA conditions were removed and the track bulldozed, the owners of the property could ride as many motorbikes on their property whenever they liked.

Councillor Arthur Lysaught questioned if the number of days the track was used - 43 according to the applicant, or 50 in the neighbour's records - constituted a nuisance.

Mr Blanchette was disappointed with the council's decision but would like to give his response more thought.
