Kerry's Aussie dream shatters

LIFE and the Australian Immigration Department sometimes just do not seem fair.

Stunned: Stephen and Kerry Fulluck and their children Ellis, 18, and Jacob, 13, will have to return to England after three years here.

LIFE and the Australian Immigration Department sometimes just do not seem fair.

Take the Fulluck family, of Glenfields. For the past three years they have been ticking all the right boxes to achieve their dream of living in Australia.

But in February - with their goal in sight - the Immigration Department changed the rules and they feel they have no choice but to go back home to England.

“We came out on a student visa in 2008 to study hairdressing and beauty as we were advised by an immigration company that this was on the skilled shortage list,” Kerry Fulluck said.

“We were told that if I came on the student visa, then when I qualified I could become a permanent resident.

“But last year, a year into my course, we heard they might be taking hairdressing off the list of skill shortages.

“We weren’t too worried as we assumed it wouldn’t apply to us as we were already here, we thought it would apply to new applicants.”

But in March the family received the terrible news that this was not so.

The Fullucks have been advised by their immigration lawyer that they could only stay was if an employer sponsored Kerry for two years.

That the Fullucks had bought a home in Australia, Mrs Fulluck studied at an Australian education institution in an industry once in short supply and their children had been attending Australian schools did not seem to qualify for them to call Australia home.

The family’s attempts to find a sponsor have also run into bad luck.

“I found a hair salon in Mooloolaba which said it would sponsor me and give me a two-year contract and then it closed down. I found another, but it changed its mind at the last minute,” Mrs Fulluck said.

With their options exhausted, Stephen and their son Jacob will return to England on Tuesday, leaving Kerry and their daughter Ellis behind to sell the family home.

“We don’t want to go back to England, we left for a better life here but it has turned into a nightmare,” Mrs Fulluck said.

“We’ve made good friends, my son represented Queensland in football, we’ve integrated and we’ve settled.

“It seems an impossibility to stay here. We’ve all worked, paid taxes, paid for schooling, medical and everything, we’ve done what we needed to do and followed the rules and regulations. But we take one step forward and then 20 steps backwards.

“We have nothing left in England as we sold everything to move here.

“We’ve put all our money into Australia, but it obviously was not good enough. They’d rather have somebody who came in on a boat.”

Of course they can't stay. They're white, espouse family values, consistent with our traditional population base. They are happy to obey our laws, respect our culture and don't show a predisposition to violence if they don't get their way. Totaly in opposition to current government policy.

One really has to wonder if our government and some of it's departments are on an extended lunch break at the pub don't you?.I mean look at it and the decisions that have been made in this area alone. This is not the first time something like this has happened so where is common sense being used. It would be understandable if this family were a mob of ratbags but it seems they are not that. I would have thought the Australian Government would want more migrants like this and help them in any way they could but not this government. Stupid decisions really reminds me of Amanda Vandstone back in the 70's and 80's, now she was a real tough nut .Maybe this current mob took lessons from her.

So we picked up four new residents from the UK so that we could get one trainee hairdresser? What about the husband? Did he have a job to go to when they all moved here?

I think that this amply demonstrates how ludicrous the Federal Government's immigration policy has been. And it amply demonstrates why permanent residence for migrant students must be canned as soon as possible.

I do have sympathy for the position which this family finds itself in but at the same I really want this ridiculous immigration loophole shut down as soon as possible.

Unbelievable. Here are people that are actually contributing to our society and community and being made to jump through the hoops. Why don't long term dolies and welfare recipients get the same treatment to explain why they can't find work or study?

Have to wonder though....when have hairdressers ever been in short supply in Australia?

I feel for this family, however the issues of the boat people are very different, they are often fleeing persecution and violence, they have also often sold their livlihoods to make the dangerous trip here, but returning to their homeland must fill them with fear as the terrrors that they left behind will still be there. I do not think england has the same problems as the countries the boat people are often fleeing from.

At the risk of perhaps sounding a bit heartless I am going to suggest that this family took advantage of a rollicking rort made possible by a bunch of immigration do-gooders in the Federal Labour Party.

That rort is apparently due to be shut down (well overdue and far too slowly) and this family has unfortunately been dealt the rough end in that process.

I don't really think that we desperately needed thousands of new trainee hairdressers in Australia. Certainly not here on the Sunshine Coast. Maybe they need them in the mining towns. Those miners are very fashion conscious.

Here's a tip...if you're into immigration rorts. Many people from the UK are getting into Australia by emigrating to NZ first. Apparently the Kiwis welcome them with open arms and then encourage them to move to Australia which has a free immigration deal with NZ.

Wink, wink...say no more. Know what I mean?

I really love the English migrants we now have all over the place. I love their 'posh' accents and chattiness when they serve me in the shops and businesses (I'm from that part of the world myself 40 years ago).

I would probably love the young aussie's too if I got the chance, but considering they just don't have jobs I don't really see them. ALL my own and my friends aussie kids are having major job problems with there being 25% unemployment in the 20 -25 year old age group, with the other 75% either not counted due to under-employment, fudged figures, or forced into paying for ridiculous TAFE and uni courses.

We're not bombing England....we're bombing Afghanistan....could be why their citizens are so keen to hop on boats?

Firstly, I think it's unfair to allow people to enter the country under one set of rules and then change the rules half way through and expect them to cop the consequences. This family should be allowed to stay - they've done nothing wrong.

I do take exception with a reference to boat people though. As has been mentioned by a few bloggers, these people don't flee their homeland and families with little more than the clothes on their back, for fun. They live in hell - getting on a boat bound for a democratic country is what they do to keep their kids alive. It's the people smugglers, who take what remains of their cash and promise them an easy entry into the country, that must be persecuted - they are the villans, not the refugees.

Please remember this amongst all the propoganda you will hear over the next 4 weeks - the vast majority of people who are in this country illegally come in by plane and hail from countries such as NZ, England and US, then overstay their visas and "take 'our' jobs". No one seems to worry about them... maybe we're a little bit racist after all??

For all those arguing that there is no such thing as an illegal asylum seeker, you should check some facts. Economics is not grounds for asylum - and when people from countries with low average incomes are paying thousands of dollars to people smugglers you have to question the real motive. Also, as per a UN report, 25% and possibly more of the Sri Lankan äsylum seekers are known to be directly connected to the Tamil Tigers, as supporters or fighters - as murderous a group of terrorists as there has ever been. And the UN has clearly stated that there is no persecution of Tamils in Sri Lanka since the Tigers were finally defeated, so what is the basis to claim asylum in Australia. A better life sure but on that basis we should accept approximately 5 BILLION people from other countries.

How many countries did they fly past to get to Indonesia, to then pay a people smuggler to get them on a boat to Australia.

The money paid to the people smugglers is raised by working as many jobs as can be fitted into 24 hours, by selling everything they own and often living rough to ensure every penny is saved. Women prostituting themselves to raise the money is very common.
If you think people who are that desperate shouldn;t be allowed in then you have an empty soul.

As for the persecution of the Tamils, you should read further instead of relying on the one report that fits your world view

Mr and Mrs Fulluck and family, I sympathize with your plight.
You seem decent people, who should be allowed to live in Australia.
But as you can see, the bleeding heart do-gooders cry foul if you mention 'Boat people'......

The Polls, nationally tell a different story though.

Australians have to be anonymous to have an opinion these days or you are a racist and will be subjected to personal attacks.

Pandanus - Just to ease your ignorance, Australia is a signatory to a piece of international law (the United Nations Convention Relating to the Status of Refugees) which stipulates that anyone can seek asylum. That is, arriving without documents and requesting protection is valued (internationally) as a human right.

So, you're completely wrong - there is nothing illegal about seeking asylum (and more people do this by our embassies or arriving by plane than boat).

What's more, we're ranked 16th in the world as a preferred destination for asylum seekers. It seems our "racist" tag doesn't make us such a great place to live after all.

As for the Fulluck family - it's a big shame, but, as mentioned above, they really should have read the small print before buying a home etc. They thought they had found a loophole, but that loophole closed - they have to take responsibility for their actions.

Quite frankly, I cut my own hair and would rather more doctors and nurses coming than beauty therapists.

Now had they been told that we need more nurses etc I would be aghast that we were letting them go, but a hairdresser???? When there are a glut of them on the coast....Also, just because you have been studying doesn't mean you are entitled to a job. There are many qualified people out there who have finished their studies and can't get a job in their field.

If these people were on a student visa, does that mean that they have not been working here??

I find it difficult to believe that they were informed by the Australian Immigration that we have a shortage of hair and beauty specialists.

I was under the impression that you needed a sponsor in order to stay in the country anyway, regardless of the study you have done..

And I also agree that the reference in the last sentence about preferring boat people....was not at all appropriate. At least these people will go back to their homeland with the money from the sale of their house, a qualification and be able to start again...the people who arrive by boat do not have a home.

Actually, I feel sorry for the family. I'm not exactly sure HOW Hairdressing is in shortage. There are WAY too many and always have been for years. I realise it's hard to do research from across the globe and they took the word of an Immigration Agent (who tell EVERYONE that they'll get to stay) but if the Commonwealth had this skill listed in short supply they've got rocks in their head!

I understand exactly what kerry and her family are going through and hope its not to late for them. Our family are in exactly the same position and we fully except any conditions the australian immigration impose. But it is disgusting to change the rules when you are so close. Put simply the people who try to gain entry into australia illegally, will try regardless of any restrictions. It dose not matter what country they are from uk, sri lanka,china,usa,anywhere they are still illegal. We always thought Australia (FAIR GO) not anymore

The Fullucks may want to try contacting Serco, the UK company contracted to manage the immigration detention centres.

It's worth a try if they are serious about staying in Australia.

Since they are British citizens, Serco may be able to sponsor them to work at a detention centre and the Dept of Immigration may look favourably on their case. Boat people and Plane people probably need to unite and help each other. This would be a good multicultural integration exercise.

Alternatively, contact USC and enrol in a 3 year Nursing Course. www.usc.edu.au

One other comment....we need to look at the root of the problem. The offshore "immigration companies" in places such as the UK and other places in Europe need to be charged and jailed. Effectively, they are "white collar people smugglers" who profit and exploit desperate people who want to travel by plane to Australia. It is inevitable that a change in government will change the rules about who is eligible to stay regarding occupation skill shortages. This is no different from the changes imposed on "boat people" who come from Afghanistan and Sri Lanka where the rules were changed. You need a back up plan when you put your life in the hands of a boat/plane people smuggler.

Nothing is a certainty - life is a big risk - even when you get sponsored by a US company with an H1B visa, a Social Security Card and classed as a "legal alien"!

I have no sympathy for the fulluck's what so ever I mean when was hairdressing a reason to immigrate and to give something to our country. In my opinion they have come here to capitalize and double their english money. I think that Australians should be taken care of first. Australians dont have it at easy if we want to immigrate. I thing this family has seen the loophole and tryed to use it to their advantage, England isnt anything like Afganistan now is it.

As a student in Australia which this family is the husband is allowed to work for 20 hours per week and yes he has indeed got a job and pays tax. The children of the student visa holder have to pay school fees of $8,000 per child per year to attend state school. The student visa holder pays (for hairdressing and beauty) a total of $25,000 for the 2 years. So for this family alone this is $57,000 !

Indeed a apart from giving up family and friends and moving 10,000 miles across the other side of the world there is firstly the medicals, references, income checks and immigration paperwork and fees to pay (aprox $5,000). This shows great commitment to a new life before even picking up a pair of scissors.

The government has invited these people into this beautiful country only to change the goal posts when they have taken everything from them. It is extremely unfair and does not show the government in a good light or even more so these people who make these negative comments who cannot even for minute know what it is like to live with this stress and uncertainty. Also they might want to ask their hairdresser how hard it is to study hairdressing not to mention beauty.

Why should these people be allowed to stay just because they bought a house and came here on a student visa? That's rediculous, rules are rules and I think we should get a little tighter with ours, we have just as many Australians needing jobs let alone having all these people coming to live here on student visas. It's not our problems that they sold everything in England, that was their decision.

England is a fine example as to why we should be so careful with who we let stay in our country. It is overrun with Middle Easterns and Eastern Europeans living there putting a massive strain on the government, welfare, health and education systems as well as causing illegal working conditions, unnecessary violence, racism and hatred. The unemployment rate in England is massive, especially for the British born and its because of these immigrant people putting such a strain on the country.

Lets learn from England's mistakes and not let our country end up like theirs. We have more than enough Poms in Australia already so unless you are coming to visit or are on a temporary visa piss off back to your own country and don't come and ruin ours.

debbiemagee: I disagree with your comment that it's not overrun. I'm currently living & working in England paying taxes and national insurance contributions and here for 2 yrs. I've lived in 2 different parts of the country and have worked in the education system in both cities. It alone is overrun with children who cannot speak or understand english nor can their families. These children spend their first year of formal schooling being taught the absolute basics of english, therefore, by the time they enter year 1 they are one year behind. Now almost HALF of the schools here are filled with middle eastern and or african children as I mentioned that cannot speak english, occaisionally there will be one or two British born children in each class and it's these children that are being held back because of their country letting all these people flock into England and take over. These British born children are being denied the right to learn what they should be learning in that particular year level and with the system the way it is, there is no going back over what should be learnt.
Also the government pay for school uniforms, school meals, accommodation, bills etc AND give migrant families money each week, thus encouraging them not to work. Not only that but generally speaking, these children are brought up very differently to the British way, they are encouraged to deal with their problems by fighting and generally being violent and aggressive, which, as a teacher I experienced daily. In most of the schools I go into, English speaking folk are the minority, which is really really sad.
Then there are the Eastern Europeans that move over to the Uk and work illegally in often more than one job for well under the minimum wage, which continues to put more and more British people out of work. Because of the EU agreement these people can come and go as they please and stay for as long as they like. They move to England, they dont make an effort to live in the 'British way' they dont attempt to learn or even speak english, they set up their own schools, churches and shops and deliberately stick to their own and they can because there is so many of them. Now dont get me wrong, I have nothing against people coming and going to different countries with permission, as I have, but I had to get permission, have a degree, and prove that I had enough money to support myself in England and am not by any means allowed to access government funds ie. welfare, and after my 2 year visa is up, I go home, which is what should happen with everyone who is in a foreign country after their time is up. People coming to Australia should come on a visa and after two years, GO HOME! People shouldn't be challenging the rules, they're there for a reason, surely a couple of years in a country is enough. All the British people I've spoken to about this issue agree with Australia's immigration laws and wish England's were as tough

aes4559: I lived there for 6 months a year for nearly 20 years until 2005. My husband is from there. We still visit about three times a year. My sister in law works for the Department of Work and Pensions (or whatever it is called now) as a benefits advisor.

What you are saying is demonstrably untrue.
